1. Age Restriction & Identification Requirement

• ALL customers purchasing any age‑restricted product are required to present a valid, current, government‑issued photo ID at the time of purchase, regardless of age, appearance, or familiarity with staff.

• Customers must be 21 years of age or older to purchase, possess, or attempt to purchase any vaping, tobacco, or alternative nicotine products in accordance with:

    • Federal Tobacco 21 Law

    • Montana Code Annotated § 16‑11‑305

• Acceptable forms of identification include:

    • State‑issued driver’s license or identification card

    • Passport or passport card

    • U.S. military identification

• No exceptions will be made. Failure to present valid identification will result in an immediate denial of sale.

• Possession, use, or attempted purchase by individuals under 21 is prohibited, including enforcement under Montana Code § 45‑5‑637.

2. Indoor Vaping & Use Restrictions

• Vaping is prohibited in all enclosed public places throughout Montana under the Montana Clean Indoor Air Act, including amendments adopted through Senate Bill 390 (2025).

• Prohibited areas include, but are not limited to:

    • Retail stores

    • Restaurants and bars

    • Workplaces

    • Gyms and other enclosed public spaces

• B‑Town Vapes Inc. reserves the right to enforce stricter policies on its premises.

3. Product Information & Availability

• Product descriptions, images, pricing, and specifications are provided for informational purposes only.

• We do not guarantee that product information is complete, current, or error‑free.

• Products may be reformulated, restricted, modified, or discontinued at any time due to manufacturer decisions or regulatory requirements.

4. Health & FDA Disclaimer

• Vaping, tobacco, and alternative nicotine products are not approved by the U.S. Food and Drug Administration (FDA) to diagnose, treat, cure, or prevent any disease.

• Nicotine is an addictive chemical and may pose health risks.

• Products are not intended for use by non‑smokers, pregnant or nursing individuals, or persons with underlying medical conditions.

• Consult a licensed healthcare professional prior to use.

5. Product Use & Safety

• Products must be used only as intended and according to manufacturer instructions.

• B‑Town Vapes Inc. is not responsible for injuries, damages, or losses resulting from:

    • Improper use or negligence

    • Failure to follow instructions

    • Modification of products

6. Federal & State Regulatory Compliance

• B‑Town Vapes Inc. complies with FDA Pre‑Market Tobacco Product Application (PMTA) requirements.

• Products sold are FDA‑authorized or legally marketed while pending FDA review where permitted by law.

• In compliance with the PACT Act, we do not ship ENDS or vaping products via USPS and adhere to all age‑verification, reporting, and record‑keeping requirements.

7. Retail Licensing

• B‑Town Vapes Inc. operates under a valid Montana retail license as required by Montana Code § 16‑11‑303 for the sale of vapor and alternative nicotine products.

8. Privacy Policy

• Your use of our website and services is governed by our Privacy Policy, which outlines how personal information is collected, used, stored, and protected.

9. Delivery & Shipping

• As of January 11, 2024, all delivery services have been permanently discontinued.

• All purchases must be made in person at authorized B‑Town Vapes retail locations.

10. Loyalty Rewards Program

• Participation in the B‑Town Vapes Inc. Loyalty Rewards Program is optional and offered at the sole discretion of the company.

• Loyalty points are:

    • Non‑transferable

    • Non‑negotiable

    • Without cash value

• Points may be redeemed in‑store only on eligible items, subject to availability and applicable exclusions.

• System changes, software updates, program restructuring, regulatory requirements, errors, suspension, or termination of the Loyalty Rewards Program may occur at any time without notice.

• In the event of any system change or program modification, previously earned loyalty points may become void and will not be honored.

• B‑Town Vapes Inc. reserves the absolute right to modify, revoke, suspend, or terminate the Loyalty Rewards Program or individual loyalty accounts at any time.

11. Coupon & Promotion Policy

• Coupons are valid only during stated promotional periods.

• One coupon per transaction unless otherwise specified.

• Coupons:

    • Cannot be combined with other offers

    • Have no cash value

    • Are void if expired

• Non‑discountable items include:

    • Sale and clearance items

    • Gift cards

    • Special orders

    • Limited‑edition items

12. All Sales Final

• All sales are final.

• No returns, refunds, or exchanges.

• Customers are encouraged to inspect or test products before leaving the store.

• Any issues must be reported immediately to store management.
